Includes the mandatory EULA licensing required for Mobile App deployments. 

1. Binding Agreement

These Terms of Use govern your access to and use of the Red River Valley School Division’s website portal and associated mobile application (the "Services"). By installing the mobile application or utilizing the web portal, you accept and agree to be bound by these Terms. If you do not agree, you must immediately uninstall the application and cease using the web portal. 

2. End User License Agreement (EULA)

The Red River Valley School Division grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to download, install, and execute the mobile application software on a mobile device that you own or legally control. This license is granted strictly for personal, non-commercial purposes to facilitate communication and access information related to your or your dependent’s educational activities within the division. 

3. Account Security and Credentials

Access to the localized portal features requires unique administrative credentials provided by the Red River Valley School Division or established via approved Single Sign-On (SSO) providers. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to immediately notify the Red River Valley School Division of any unauthorized access or security breach. 

4. Acceptable Use Policy

You agree to use the Services only for lawful, school-related purposes. You are strictly prohibited from: 

• Uploading, transmitting, or distributing content that is unlawful, defamatory, harassing, abusive, threatening, harmful, vulgar, or discriminatory. 
• Attempting to reverse-engineer, decompile, crawl, scrape, or systematically harvest data from the web code or mobile software. 
• Interfering with, disrupting, or testing the vulnerability of network security layers or hosting servers. 
• Using the communications infrastructure to distribute unsolicited commercial messaging or spam. 

The Red River Valley School Division reserves the right to suspend or terminate portal and application access immediately, without prior notice, for any user found in violation of this section. 

5. Push Notifications & Delivery Disclaimer

The mobile application provides optional push notifications for school updates, weather closures, and division announcements. You acknowledge that push notifications rely on third-party infrastructure, including your mobile network provider, Apple Inc. (APNs), and Google LLC (FCM). The Red River Valley School Division does not guarantee 100% or instantaneous delivery of these transmissions. It remains the user's responsibility to independently verify critical operational schedules, attendance status, and emergency notices via official communication channels or direct school contact. 

6. Intellectual Property Rights

All software frameworks, user interface designs, logos, text, graphics, and branding assets contained within the Services are the exclusive property of the Red River Valley School Division, SchoolBundle, or their respective third-party technology partners. You acquire no ownership rights by downloading or using the platform. 

7. Mobile App Store Provider Disclosures

• Parties: You acknowledge that these Terms are executed solely between you and the Red River Valley School Division, not with Apple Inc. or Google LLC. The Red River Valley School Division is solely responsible for the mobile application software and its underlying data. 
• Maintenance & Support: The Red River Valley School Division is entirely responsible for provisioning software maintenance and technical support for the platform. Apple Inc. and Google LLC have no legal obligation to furnish maintenance or support services for the application. 
• Warranty & Liability Limitations: To the maximum extent permitted by applicable law, Apple Inc. and Google LLC waive all warranty obligations regarding the mobile software. Any claims, damages, liabilities, or losses attributable to software non-conformance are the responsibility of the Red River Valley School Division, subject to the limitations set forth in Section 8. 

8. Exclusion of Warranties and Limitation of Liability

The Services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. The Red River Valley School Division does not warrant that the application or web portal will operate completely uninterrupted, error-free, or clear of localized software bugs. 

To the maximum extent permitted by the laws of Manitoba, the Red River Valley School Division, its trustees, officers, employees, and technology partners (including SchoolBundle) shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of or inability to use the portal or mobile software. 

9. Amendments

The Red River Valley School Division reserves the right to modify these Terms of Use at any time. Revised terms will be posted directly within the platform interface, and your continued use of the website or mobile application following such updates constitutes definitive acceptance of the modified agreement. 

10. Governing Law

These Terms of Use are governed by, and shall be construed in accordance with, the laws of the Province of Manitoba and the federal laws of Canada applicable therein. Any legal action or proceeding arising under these Terms shall be brought exclusively in a court of competent jurisdiction within Manitoba.
